MarqOS strives to provide reliable and uninterrupted Services but does not guarantee:

Continuous availability
Error-free operation
Uninterrupted access
Compatibility with all systems or devices

Scheduled maintenance, upgrades, or unforeseen events may temporarily affect service availability.

11. Confidentiality

Each party agrees to protect confidential information received from the other party using reasonable safeguards.

Confidential information does not include information that:

Is publicly available.
Was independently developed.
Was lawfully obtained from a third party.
Must be disclosed by law or legal process.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARQOS DISCLAIMS ALL WARRANTIES, INCLUDING:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF INFORMATION
UNINTERRUPTED OR ERROR-FREE OPERATION

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MARQOS SHALL NOT BE LIABLE FOR:

INDIRECT DAMAGES
INCIDENTAL DAMAGES
SPECIAL DAMAGES
CONSEQUENTIAL DAMAGES
LOSS OF PROFITS
LOSS OF DATA
BUSINESS INTERRUPTION

MARQOS’S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU TO MARQOS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless MarqOS, its affiliates, employees, directors, and partners from claims, liabilities, damages, and expenses arising from:

Your use of the Services.
Your violation of these Terms.
Your violation of applicable laws.
Your Customer Data.

15. Termination

MarqOS may suspend or terminate access to the Services if:

You violate these Terms.
Required by law.
Necessary to protect platform security or integrity.

You may stop using the Services at any time.

Provisions relating to intellectual property, confidentiality, liability limitations, and indemnification will survive termination.

16. Changes to Services

MarqOS may modify, enhance, discontinue, or replace portions of the Services at any time.

We will make reasonable efforts to notify customers of material changes where appropriate.

17. Changes to These Terms

MarqOS may update these Terms periodically.
